By accessing or using LandlordCollect ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

LandlordCollect is an online rent collection and property management platform that allows landlords to collect rent payments, manage properties and tenants, and send automated payment reminders. The service is provided via landlordcollect.com.

3. Account Registration

To use our service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activity that occurs under your account

4. Subscription and Billing

LandlordCollect offers paid subscription plans. By subscribing, you agree to:

• Pay the applicable subscription fees for your chosen plan
• All subscriptions are billed monthly or annually as selected
• Subscriptions automatically renew unless cancelled before the renewal date
• 14-day free trials are available for new subscribers
• No refunds are provided for partial months or unused portions of a subscription
• We reserve the right to change pricing with 30 days advance notice

Payment processing is handled by Stripe. By using our payment features, you also agree to Stripe's Terms of Service.

5. Acceptable Use

You agree to use LandlordCollect only for lawful purposes. You may not:

• Use the service for any illegal purpose or in violation of any laws
• Harass, threaten, or intimidate tenants through our platform
• Send spam or unsolicited communications
• Attempt to gain unauthorized access to our systems
• Upload malicious code or interfere with the service
• Misrepresent yourself or your properties
• Use the service to discriminate against tenants based on protected characteristics

6. Landlord Responsibilities

As a landlord using our platform, you are solely responsible for:

• Complying with all applicable landlord-tenant laws in your jurisdiction
• The accuracy of property and tenant information you enter
• Obtaining appropriate consent from tenants to collect their personal information
• Setting appropriate rent amounts and late fees in compliance with local laws
• All communications sent to tenants through our platform

7. Tenant Data

You retain ownership of all tenant data you enter into LandlordCollect. By entering tenant information, you represent that you have the legal right to collect and process this information. You grant us a limited license to use this data solely to provide the service to you.

8. Intellectual Property

LandlordCollect and its content, features, and functionality are owned by LandlordCollect and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform without written permission.

9. Disclaimers

LandlordCollect is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. We are not responsible for any losses resulting from unauthorized access to your account.

LandlordCollect does not provide legal advice. Nothing on our platform constitutes legal advice regarding landlord-tenant law. You should consult a qualified attorney for legal guidance.

10. Limitation of Liability

To the maximum extent permitted by law, LandlordCollect shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, lost data, or business interruption.

11. Indemnification

You agree to indemnify and hold harmless LandlordCollect from any claims, damages, or expenses arising from your use of the service, violation of these terms, or violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these terms. You may cancel your account at any time. Upon termination, your access to the service will cease and your data will be deleted within 30 days.

13. Governing Law

These terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York.

14. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will provide 30 days notice of material changes.
